1. ELIGIBILITY
The SeaStar Adventures Review Contest is open and available to individuals
who share their travel experience and writings about a SeaStar
Adventures Tour or Class. TheSeaStar Adventures Review Contest
is offered and open to legal residents of the United States and
its territories and to legal residents of Canada, who are at least
18 years old.
2. CONTEST PERIOD
The contest CONCLUDES ON June 1, 2008 at 23:59 (PST), but can be
modified by SeaStar Adventures, Inc. All modifications will be
posted on the SeaStar Adventures website at the following location: http://www.seastaradventures.com/review.html
3. ENTRY
In order to enter the SeaStar Adventures Review Contest, you go to
one of the independent review sites on our list, and write a review
about your personal SeaStar Adventures experience. Once the
review is posted, you must fill out the entry form and include
the link where your review is posted. You, yourself, do not have
to be the purchaser of a SeaStar Adventures Tour or Class,
in order to enter the contest.
In order to enter to win you must: Successfully send us your experience,
story and SeaStar Adventures Review and URL where your review is
otherwise listed, which must include your Email Address and
the date of your tour or class.
You can submit up to 5 reviews about your experience, but each entry
must be a unique.
Multiple entries are allowed however, there may be only 1 (one) winner
selected per household.
4. USE OF ENTRIES
All entrants will consent to their name, SeaStar Adventures Review
submission, along with the town/city and state/province where they
reside; to be used on the SeaStar Adventures web sites or any future
SeaStar Adventures marketing or publicity materials or publications.
All submissions become the property of SeaStar Adventures, Inc.
5. DRAWING
Three (3) prize winners will be selected based on the best SeaStar
Adventures Reviews (as chosen by our judges) submitted after September
1st, 2007 from eligible entries received during the Contest Period.
Each winner will receive written notification by email from SeaStar
Adventures confirming their contact information and each winner
must reply to the email and confirm all of their contact information
within 5 (Five) business days of receiving the notification email.
SeaStar Adventures reserves the right to cancel the winning selection
after the fifth (5th) business day passes, in which case the prize
will be forfeited and an alternate winner will be selected. Any alternate
winner will be selected randomly through a subsequent drawing.
6. PRIZE/ODDS
Three (3) Total Prizes of 1 Eight Day-7 Night Condominium Vacation,
1 Amazon.com gift-card valued at $200, and 1 Three Day- 2 Night
Resort Vacation. One prize can be awarded per entry. Prizes cannot
be redeemed for cash.
Odds of winning in this random drawing depend on the number of eligible
entries received for the Contest period. No assignment, transfer
or substitution of prize is permitted. Prize winners are advised
that Tax implications or hotel fees may arise from their prize winnings
and they should seek independent financial advice prior to the acceptance
of the prize.
7. PRIVACY POLICY
We will only collect personal information that
is provided to us to complete the entry to the Go Review
Contest. This includes any information that can be used
to identify you individually, such as name, e-mail address
and mailing address. All qualified, selected winners must
reply to the SeaStar Adventuress winner notification emails
with the following information to verify the winners: Full
name, Mailing address and Phone number. This specific information
will only be collected for each winner of the SeaStar Adventures
Review Contest. We will never sell or rent any personal
information to any third party for marketing, commercial,
or any other purpose. The information will be used for
the distribution of prizes and may be used by SeaStar Adventures,
Inc. for future promotional, marketing and publicity purposes.
You must provide this information in order to participate
in the competition.
8. GENERAL CONDITIONS & LIMITATIONS
By accepting a prize, each winner releases and
agrees to hold harmless SeaStar Adventures, Inc. from any
and all liability for any injuries, loss or damage of any
kind to person, including death, and property, arising
in whole or in part, directly or indirectly, from acceptance,
possession, use or misuse of a prize, participation in
any sweepstakes related activity, or participation in this
SeaStar Adventures Review Contest.
As a condition to accepting a prize, winners will consent to their
name, pictures along with the town/city and state/province where
they reside; being added to the list of winners posted online or
through any future SeaStar Adventures marketing or publicity materials.
Any use of robotic, automatic, macro, programmed or like entry methods
will void all such entries by such methods and persons using any
such methods will be disqualified.
If for any reason this SeaStar Adventures Review Contest is not capable
of running as planned due to infection by computer virus, bugs, tampering,
unauthorized intervention, fraud, technical failures, or any other
causes which, in the sole opinion of SeaStar Adventures, Inc., corrupt
or affect the administration, security, fairness, integrity, or proper
conduct of this SeaStar Adventures Review Contest, SeaStar Adventures,
Inc. reserves the right to cancel, terminate, modify or suspend the
SeaStar Adventures Review Contest and conduct a random drawing to
award the Prizes using all eligible non-suspect entries received
as of the date on which any such action is taken or as deemed fair
and appropriate by SeaStar Adventures, Inc. subject to any direction
given under the Lottery and Gaming Regulation 1993 (SA), and state
permit regulation. If the SeaStar Adventures Review Contest is terminated
due to tampering or technical difficulties prior to its expiration
date, notice will be posted at http://www.seastaradventures.com/review.html.
SeaStar Adventures, Inc. assumes no responsibility for any error,
omission, interruption, deletion, defect, delay in operation or transmission,
communications line failure, theft or destruction or unauthorized
access to, or alteration of, entries. SeaStar Adventures, Inc. is
not responsible for any problems or technical malfunction of any
telephone network or telephone lines, computer on-line systems, servers,
or providers, computer equipment, software, failure of any e-mail
or entry to be received by SeaStar Adventures, Inc. on account of
technical problems, human error or traffic congestion on the Internet
or at any Web site, or any combination thereof. Employees and their
immediate families of SeaStar Adventures, Inc. are ineligible.
9. DISPUTES
Except where prohibited, as a condition of participating the SeaStar
Adventures Review Contest, participant agrees that any and all
disputes which cannot be resolved between the parties, claims and
causes of action arising out of or connected with this SeaStar
Adventures Review Contest, or any prizes awarded, or the determination
of winners shall be resolved individually, without resort to any
form of class action exclusively by arbitration pursuant to the
commercial arbitration rules of the American Arbitration Association,
then effective. Further, in any such dispute, under no circumstances
will participant be permitted to obtain awards for, and hereby
waives all rights to claim punitive, incidental or consequential
damages, or any other damages, including attorneys' fees, other
than participant's actual out-of-pocket expenses (i.e., costs associated
with entering this SeaStar Adventures Review Contest), and participant
further waives all rights to have damages multiplied or increased.
All issues and questions concerning the construction, validity,
interpretation and enforceability of these Official Rules, or the
rights and obligations of participant and SeaStar Adventures,
Inc. in connection with the SeaStar Adventures Review Contest,
shall be governed by, and construed in accordance with, the laws
of the State of California without giving effect to the conflict
of laws rules thereof, and all proceedings shall take place in
that State in the City of Poway, State of California.
10. WINNERS LIST
The names, writing(s), hometown, and testimony of the winners may
be posted on any of the SeaStar Adventures owned and operated websites.
